QFC Employment Regulation Amendments: Adapting to Qatar’s New Social Security Law

The Qatar Financial Centre Authority (the “QFCA”) has introduced key amendments to the QFC Employment Regulations, bringing them into alignment with Qatar’s new Social Security Law No. 1 of 2022 (the “Social Security Law”).

These amendments, which came into force on 20 February 2025, clarify and reinforce the pension and social security obligations of employers and employees operating within the Qatar Financial Centre (“QFC”).

The changes reflect a major shift in how pension contributions are handled in the QFC, ensuring that Qatari employees working in the QFC are fully integrated into the national social security system.

Background: The Transition from the Retirement and Pensions Law to the Social Security Law

On 3 July 2022, Qatar enacted the Social Security Law, which repealed and replaced the previous Retirement and Pensions Law No. 24 of 2002 (the “Retirement and Pension Law”). The new law introduced a modernized and more inclusive pension system, significantly expanding the scope of coverage to include private sector employees—a fundamental departure from the previous framework.

What Changed?

Under the previous system, pension contributions were limited to Qatari employees working for:

  • Government ministries and public institutions
  • State agencies
  • Corporations
  • Other entities designated by the Council of Ministers

With the introduction of the Social Security Law, the scope of coverage has expanded significantly. Now, all Qatari nationals, whether working in the government or private sector, must be enrolled in the national social security scheme, provided that:

  • They are at least 18 years old, and
  • Their employment is regular and permanent for a period exceeding one year.

This means that all private sector employers—including those operating in the QFC—are now legally obligated to register their Qatari employees for pension contributions and comply with the updated social security requirements.

Impact on QFC Employment Regulations

  1. Amendment of Article 25A

The amendment to Article 25A is an essential and necessary update to the QFC Employment Regulations, as it updates the legal framework governing pension contributions for Qatari employees working in the QFC.

    - Old Provision:

    “Article 25A– Retirement and Pension

    (1) Notwithstanding Article 2(4)(Application), the Retirement and Pensions Law shall apply to all Employees of Qatari nationality employed by the QFC Authority, the Regulatory Authority and any other Employer which may be determined by resolution of the Council of Ministers and notified by that Council in writing of the determination.

    (2) All Employers described in paragraph (1) shall cooperate with the General Retirement and Social Insurance Authority and take the necessary steps to implement the Retirement and Pensions Law.

    (3) The application of the Retirement and Pensions Law pursuant to paragraph (1) shall take effect from the date prescribed in the Council of Ministers’ decision”.

    - New Provision

    “Article 25A– Retirement and Pension

    (1) Notwithstanding Article 2(4) (Application), the Social Security Law applies to Employees in accordance with its provisions.

    (2) Subject to the application of the Social Security Law, all Employers shall cooperate with the General Retirement and Social Insurance Authority and take the necessary steps to implement the Social Security Law”.

Previously, Article 25A required compliance with the Retirement and Pensions Law only for Qatari employees of the QFC Authority, the QFC Regulatory Authority, and other employers designated by the Council of Ministers. Under the old version of Article 25A, only the mentioned employers by the article were obligated to cooperate with the General Retirement and Social Insurance Authority (the “GRSIA”).

Under the new provision, the requirement to register for pensions automatically applies to all Qatari employees in the QFC, and now, all employers within the QFC—the QFC Authority, the Regulatory Authority, the QFC Commercial and Civil Court, the Regulatory Tribunal, QFC Institutions, and any other QFC Entity employing one or more Qatari individuals—are required to cooperate with the GRSIA to ensure compliance with the updated social security regulations.

Thus, QFC Employment Regulations – specifically Article 25A - have been amended to align with the expanded scope of the Social Security Law. These amendments reflect the broader application of the Social Security Law, ensuring that the QFC framework adapts to the inclusion of all Qatari employees and a wider range of employers under the national social security system.

To proceed, it is important to clarify that the QFC Employment Regulations define an Employee as:

    • A Sponsored Employee (non-Qatari nationals), or
    • A Qatari national or an individual sponsored in Qatar by a family member and employed by an Employer.

This definition creates some ambiguity in the interpretation of Article 25A of the QFC Employment Regulations, as the same article uses the term “Employee”, raising therefore the question of whether non-Qatari employees fall under Article 25A and, consequently, the Social Security Law.

However, the Social Security Law, in Chapter 2 titled "Subject of this Law," explicitly defines its scope. Articles 2 and 3 state that the Social Security Law applies solely to Qatari employees.

Furthermore, Article 2(4) of the QFC Employment Regulations affirms that these regulations operate independently of all other Qatari laws, rules, and regulations—except for the Social Security Law, to which they are expressly subject.

Thus, based on Articles 2 and 3 of the Social Security Law, and Article 2(4) of the QFC Employment Regulations, it is evident that the term Employee in Article 25A of the QFC Employment Regulations does not extend to non-Qatari employees, even though such regulations broadly define an “Employee” to include both Qatari and non-Qatari employees, as the Social Security Law’s application remains limited to Qatari employees.

Therefore, employers should note that, despite the inclusive definition of Employee in the QFC Employment Regulations, only Qatari employees are obligated to participate in the pension scheme under the Social Security Law.

  2. Article 66 – Updated Definitions

To ensure consistency across the QFC Employment Regulations, Article 66 (Definitions) has been amended to reflect the replacement of the old Retirement and Pensions Law with the Social Security Law.

    Old Definition:

“Retirement and Pensions Law: Law No. (24) of 2002 of the State on Retirement and Pensions (as amended), or such other laws that may substitute it from time to time”.

    New Definition:

“Social Security Law: Law No. (1) of 2022 of the State (as amended), or such other laws that may substitute it from time to time”

This ensures that all references to pension laws in the QFC Employment Regulations are aligned with Qatar’s updated legal framework.

  3. No Change to Article 2(4) – QFC Employment Regulations Autonomy

Article 2(4) of the QFC Employment Regulations remains unchanged, reaffirming that:

"Subject to Article 25A, no laws, rules, and regulations of the State relating to employment shall apply to Employees whose employment is governed by these Regulations”.

This means that apart from the pension-related obligations outlined in Article 25A – which are now subject to the Social Security Law, other employment-related laws of Qatar do not apply to employees working under the QFC Employment Regulations.

Conclusion

The recent amendments to the QFC Employment Regulations bring significant changes to employer responsibilities within the QFC, aligning the framework with Qatar’s national social security system governed by the Social Security Law. By incorporating the Social Security Law, the QFC ensures that all Qatari employees in the QFC now have access to the same pension protections as employees in other sectors. This expansion is an important step in reinforcing Qatar’s commitment to long-term financial security for its workforce, ensuring that Qatari employees are better supported in their retirement years.

For employers in the QFC, these amendments provide clear guidelines about their responsibilities, making it easier to understand how to comply with the new requirements. They should take immediate action by registering all eligible Qatari employees with the GRSIA to ensure pension contributions are made in line with the Social Security Law. Additionally, it's crucial to review and update employment contracts and payroll systems to align with the revised pension requirements, ensuring full compliance and smooth implementation of the changes.
